Terms of Service

§ 1 Scope
These Terms of Service apply to all contracts between Higrate GmbH (hereinafter „Provider“) and the user regarding the Realtalk WhatsApp service at gorealtalk.com.
§ 2 Subject of contract
Realtalk is an AI communication coach accessible via WhatsApp. The service analyzes messages, questions, situations and screenshots submitted by the user and delivers tailored assessments, reply suggestions and action strategies. The service is provided as digital content on a non-physical medium.
The AI's outputs are non-deterministic. The Provider makes no guarantee that any given response will meet the user's subjective expectations. Realtalk is not a substitute for psychological, therapeutic or medical advice.
§ 3 How the service works
The user contacts the WhatsApp Business account „Go Real Talk“. The user can forward messages, ask questions, describe situations and send screenshots. Realtalk responds with an analysis of the pattern, a read of the situation and — on request — specific reply options or strategies. The conversation history is stored so that the service can refer back to earlier context.
§ 4 Conclusion of contract
The presentation of the plans on gorealtalk.com does not constitute a binding offer. The user makes a binding offer by selecting a plan and completing payment via Stripe. The contract takes effect upon payment confirmation by the Provider.
§ 5 Pricing and payment
- First free analysis: New users receive one first Realtalk analysis free of charge, with no payment method required.
- Paid trial access:1.00 € one-time for 3 calendar days of full access to Realtalk Unlimited. The fee is charged immediately upon booking.
- Realtalk Unlimited:9.90 € per month, automatically recurring from day 4 of the subscription (immediately following the paid trial access). Unlimited analyses, questions, screenshots and strategies. Subject to fair use (rate limiting from approximately 50 interactions per day to protect against abuse).
The first free analysis does notautomatically convert into a paid subscription. A subscription only comes into effect when the user actively books the „Realtalk Unlimited“ plan including the paid trial access via Stripe checkout.
§ 6 Subscription and cancellation
The Realtalk Unlimited subscription renews automatically each month. The user can cancel at any time via the Stripe portal or by sending a message to Realtalk („cancel“). The cancellation takes effect at the end of the current billing period — until then, the service remains fully available. Once the cancellation takes effect, access to Realtalk ends.
Cancellation during the 3-day trial:If the subscription is cancelled within the first 3 days after booking, no further 9.90 € charges will be triggered. The trial fee already paid (1.00 €) is not refunded, as the service for this period has already been rendered and access remains available through day 3.
§ 7 Right of withdrawal (consumers)
Consumers within the meaning of § 13 BGB have a statutory 14-day right of withdrawal for distance contracts. The right of withdrawal expires, however, as soon as performance of the service has commenced (§ 356 para. 5 BGB) — i.e. as soon as Realtalk has produced the first analysis. By completing the booking, the user expressly consents to the immediate commencement of the service and acknowledges that their right of withdrawal thereby expires.
§ 8 Usage rights
The user receives a simple, unlimited right to use Realtalk's outputs for personal, non-commercial purposes. Sharing excerpts with trusted individuals is permitted. Commercial use, publication or transfer to third parties requires the Provider's prior written consent.
§ 9 User obligations
The user agrees not to submit any content that:
- constitutes or announces a criminal offense,
- infringes third-party rights (e.g. personality, copyright or trademark rights),
- contains malware, or
- threatens the integrity of Realtalk's systems (e.g. prompt injection aimed at manipulating or disabling the service).
In the event of a breach, the Provider is entitled to block the account without prior notice.
§ 10 Liability
The Provider is liable without limitation for intent and gross negligence, and for damages arising from injury to life, body or health. For ordinary negligence, the Provider is liable only for the breach of essential contractual obligations (cardinal obligations) and only up to the damage typically foreseeable under the contract.
The Provider makes no guarantee that the assessments and action strategies provided by Realtalk will be accurate in every individual case or will produce the outcomes desired by the user. Realtalk is a tool for reflection and communication, not a substitute for personal decision-making or professional advice.
§ 11 Changes to these Terms
The Provider may amend these Terms on at least 30 days' notice before the changes take effect. The changes will be communicated to the user by email or WhatsApp message. If the user does not object within the notice period, the changes are deemed accepted.
§ 12 Applicable law and jurisdiction
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with merchants is the registered office of the Provider (Berlin). For disputes with consumers, the statutory rules apply.
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the applicable statutory rule.
